Primero. REVOCAR la sentencia proferida por el Juzgado
Primero. Penal del Circuito de Duitama de fecha 6 de junio del 2000.
Segundo. Con arreglo al artículo 4 de la Constitución INAPLICAR en el presente caso, por ser incompatible con ella, la Resolución No. 5261 de 5 de agosto de 1994, disposiciones semejantes emanadas del Ministerio de Salud.
Tercero. CONCEDER el amparo solicitado, y en consecuencia, ordenar a la EPS SALUDCOOP - Seccional Duitama, que dentro del término de 48 horas contadas a partir de la presente providencia suministre a la niña Marina Abril Barreto, los zapatos ortopédicos que le fueron prescritos por el médico tratante y que requiera para el tratamiento ortopédico. En consecuencia, la EPS demandada podrá repetir contra el Fondo de Solidaridad y Garantía, Subcuenta especial -Ministerio de Salud, por el valor pertinente del tratamiento y los elementos ortopédicos suministrados.
Cuarto. Por Secretaria general, líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
