- PRIMERO. REVOCAR la sentencia proferida en el asunto de la referencia por el Juzgado
- Primero. Civil del Circuito de Melgar de fecha 22 de Abril de 2003 y en su lugar, tutelar el derecho a la salud en conexidad con el derecho a la vida en condiciones dignas del Señor Alvaro Guayara Villanueva.
- SEGUNDO. ORDENAR, en consecuencia a la EPS Humana Vivir S.A. Seccional Tolima, que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, brinde al señor Alvaro Guayara Villanueva, la atención integral en salud que requiere para tratar la hernia umbilical que padece, esto es, suministrándole la asistencia médica y quirúrgica que requiera, y proveyéndole los medicamentos que sean necesarios, para la recuperación de la salud del actor.
- TERCERO. Declarar que la E.P.S Humana Vivir S.A. tiene derecho a repetir contra el Ministerio de Salud Fondo de Solidaridad y Garantías (FOSYGA), para que se le reembolse el valor del servicio médico que requiere el tutelante, en cumplimiento de este fallo.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
