- Primero. REVOCAR la decision del Tribunal Superior de Pereira, Sala Penal, pronunciada en la tutela de la referencia el 30 de septiembre de 1997, y, en su lugar CONFIRMAR el fallo de primera instancia del Juzgado 3deg Penal del Circuito de Pereira el 5 de septiembre de 1997, con la ADICION de que la E. P. S. SALUDCOOP podra repetir contra el Estado en los terminos indicados en el presente fallo.
- Segundo. Por Secretaria se librara la comunicacion de que trata el articulo 36 del decreto 2591 de 1991, para los efectos del caso.
