- Primero. Revócase, la sentencia del dos (2) de octubre de 2003 proferida por el Juzgado Veintitrés Civil del Circuito de Bogotá, en la acción de tutela instaurada por el señor José Alberto Rodríguez Lozano, en contra de la EPS Compensar. En su lugar, Concédase el amparo solicitado.
- Segundo. Ordénase al representante legal de la EPS Compensar o a quien haga sus veces que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, suministre los medicamentos "Tersantan x 50 Mg y Pravacol x 40 Mg" prescritos al actor, por el tiempo que ordene el médico tratante y otorgue la atención médica necesaria para el tratamiento de su enfermedad.
- Tercero. A la Empresa Promotora de Salud demandada, le asiste el derecho de repetir por lo que pague en cumplimiento de este fallo de tutela ante el Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (Fosyga).
- Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
