- Primero. REVOCAR la sentencia proferida por Sala de Decisión Civil del Tribunal Superior de Pereira; en su lugar conceder la tutela a la salud del menor JUAN PABLO GONZÁLEZ SÁNCHEZ.
- Segundo. ORDENAR al Servicio Occidental de Salud S.O.S. E.P.S. seccional Pereira, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, realice la evaluación médica del menor JUAN PABLO GONZÁLEZ SÁNCHEZ, cuyo médico tratante deberá expedir simultáneamente la fórmula prescriptiva de los medicamentos necesarios, con la subsiguiente obligación de la E.P.S de entregarle al paciente tales medicamentos dentro del mismo plazo.
- Tercero. ORDENAR al Servicio Occidental de Salud S.O.S. E.P.S. Seccional Pereira, que dentro del mismo término informe al padre del menor sobre las posibilidades que le asisten de solicitar la conformación de un Comité Técnico Científico que valore y califique la situación de salud del menor, en lo relativo a los medicamentos que deben proporcionársele.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
