- Primero. REVOCAR la sentencia proferida por el Juzgado
- Primero. Civil del Circuito de Santa Marta, el nueve (9) de octubre de mil novecientos noventa y seis (1996).
- Segundo. CONCEDER la tutela de los derechos a la igualdad, a la vida y a la salud del señor Oswaldo Vergara Vives. En consecuencia se ordena al Instituto de Seguros Seccional Magdalena para que, en el término de cuarenta y ocho horas (48), contadas a partir de la notificación de esta providencia, proceda a suministrar al señor Oswaldo Vergara Vives los medicamentos requeridos para la protección de su derecho a la salud, especialmente el suministro de "Diltiazem Retard 180 mg" en la forma indicada por el médico tratante de esa entidad.
- Tercero. LÍBRENSE, por Secretaría General, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
