- PRIMERO. CONFIRMAR, la sentencia objeto de revision, proferida por la Sala Civil-Familia-Laboral del Tribunal Superior de Valledupar, el 5 de junio de 2001 en cuanto ordeno la entrega de medicamentos recetados por el medico tratante a Cenaida Virginia de la Cruz Frias, pudiendo la Caja Nacional de Prevision repetir contra el Fosiga; con la siguiente adicion: la orden de entrega de medicamentos se basa en la inaplicacion para el caso concreto del literal g) del articulo 15 del decreto 1938 de 1934, en cuanto excluye el suministro de medicamentos que no se encuentren expresamente autorizados en el Manual de Medicamentos y Terapeutica del Plan Obligatorio de Salud; y la suma a repetir contra el Fosiga es solo por la cantidad que exceda respecto a otra droga de similar calidad y que si figure en el listado.
- SEGUNDO. Por Secretaria, LIBRESE la comunicacion prevista por el articulo 36 del decreto 2591 de 1991.
