- PRIMERO. REVOCAR el fallo del Juzgado
- Segundo. de Familia de Neiva de fecha 2 de diciembre de 2002. En consecuencia, CONCEDER la tutela solicitada por el señor MILCIADES NARVAEZ QUINTERO, por las razones expuestas anteriormente en la parte motiva.
- SEGUNDO. INAPLICAR de conformidad con el artículo 4º de la Constitución Política y para el caso específico el parágrafo del artículo 12 de la Resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7º del Acuerdo 08 de 1994 del Consejo Nacional de Seguridad Social en Salud.
- TERCERO. ORDENAR a la EPS del Instituto de Seguro Social, Seccional de Huila que dentro del término de cuarenta y ocho (48) horas contadas a partir de la comunicación del presente fallo, proceda a ordenar el efectivo suministro de la silla de ruedas al señor MILCIADES NARVAEZ QUINTERO.
- CUARTO. AUTORIZAR a la EPS del Instituto de Seguro Social a repetir contra el FOSYGA, por el recobro de los dineros invertidos en el suministro de la silla de ruedas.
- QUINTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
