- PRIMERO. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Sincelejo de fecha 09 de 2002. En consecuencia, CONCEDER la tutela solicitada por el señor DANIEL GAMARRA GUERRA, por las razones expuestas anteriormente en la parte motiva.
- SEGUNDO. INAPLICAR de conformidad con el artículo 4º de la Constitución Política y para este caso específico el parágrafo del artículo 12 de la resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7 del Acuerdo 08 de 1994 del Consejo Nacional de Seguridad Social en Salud.
- TERCERO. ORDENAR a la EPS de CAJANAL que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a ordenar el efectivo suministro e implantación de los audífonos al señor DANIEL GAMARRA GUERRA.
- CUARTO. AUTORIZAR a la E.P.S. de CAJANAL a repetir contra el FOSYGA, por el recobro de los dineros invertidos en el suministro de los audífonos en mención.
- QUINTO. LÍBRENSE las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
