- Primero. REVOCAR la sentencia de segunda instancia proferida por el Juzgado Treinta y Seis Penal del Circuito de Bogotá, mediante la cual decidió CONFIRMAR el fallo dictado por el Juzgado Ochenta y Seis Penal Municipal de Bogotá, y en su lugar TUTELAR el derecho a la salud en conexidad con los derechos fundamentales a la vida en condiciones dignas y a la integridad personal de Adalberto Manjarrés Valencia
- Segundo. ORDENAR a Susalud E.P.S. que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del fallo, entregue la prótesis "convencional para amputación de rodilla Mll, rodilla libre, pie tipo sach importado 27L tacón 25 mm" al accionante.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
