- Primero. REVOCAR la Sentencia de segunda instancia, proferida por la Sala de Casación Civil y Agraria de la Corte Suprema de Justicia, por las razones expuestas en la presente Sentencia, y en su lugar CONCEDER la protección de los derechos al debido proceso, a la defensa y a la igualdad material del accionante.
- Segundo. ORDENAR al Juzgado
- Primero. Civil del Circuito de La Dorada que, dentro de las cuarenta y ocho horas siguientes, ANULE el fallo dictado dentro del proceso ejecutivo singular iniciado por el Banco Industrial Colombiano -ahora Bancolombia- contra los señores Frans Eduard Chavarro Jiménez y Orlando Hoyos Vásquez con base en la decisión de tutela de segunda instancia proferida por la Corte Suprema de Justicia y proceda a dictar nuevamente tal providencia, de conformidad con lo establecido en la parte motiva de la presente Sentencia.
