- R E S U E L V E
- PRIMERO. CONFIRMAR la sentencia de tutela del 18 de febrero de 1992 proferida por el JUZGADO
- PRIMERO. CIVIL MUNICIPAL de Santafé de Bogotá.
- SEGUNDO. MODIFICAR la mencionada providencia en el sentido de CONCEDER la tutela por la violación del derecho fundamental a la seguridad social, en particular, el derecho al pago oportuno y al reajuste periódico de la pensión legal reconocida al señor HERNANDO DE JESUS BLANCO ANGARITA.
- TERCERO. ADICIONAR el fallo de tutela revisado en el sentido de CONDENAR en abstracto a la Nación, Caja Nacional de Previsión Social, (establecimiento público del orden nacional adscrito al Ministerio de Trabajo y Seguridad Social), al pago de la indemnización correspondiente en favor del señor HERNANDO DE JESUS BLANCO ANGARITA, la cual deberá liquidarse de conformidad con lo establecido en el artículo 25 del Decreto 2591 de 1991 y según lo dispuesto en los numerales 35 y 36 de los fundamentos jurídicos.
- CUARTO. ADICIONAR el fallo de tutela revisado en el sentido de ADVERTIR a los servidores públicos de la Caja Nacional de Previsión Social - Subdirección de Prestaciones Económicas - Sección Pensiones del Magisterio para que no vuelvan a incurrir en la violación de los derechos fundamentales aquí protegidos.
- QUINTO. NOTIFICAR al Director General de la Caja Nacional de Previsión Social la presente decisión, así como al Juzgado
- Primero. Civil Municipal de Santafé de Bogotá para los efectos del artículo 36 del Decreto 2591 de 1991.
