- PRIMERO. REVOCAR las sentencias de tutela revisadas, proferidas por la Corte Suprema de Justicia, Sala de Casacion Civil, y por el Tribunal Superior del Distrito Judicial de Santa Fe de Bogota, Sala Civil, la primera de fecha 29 de noviembre de 1993 y la segunda de fecha octubre 14 de 1993.
- SEGUNDO. En su lugar CONCEDER PARCIALMENTE la tutela a la sociedad SEGUROS ALFA S.A. de sus derechos fundamentales de acceso a la justicia y debido proceso.
- TERCERO. En consecuencia, se dispone restablecer a la actora en la integridad de sus derechos fundamentales y devolver el expediente al Tribunal que establecio la cuantificacion de los perjuicios moratorios, a fin de que de conformidad con lo senalado en los fundamentos de esta sentencia rehaga la liquidacion y para el efecto dicte nuevo auto suficientemente fundado y congruente, lo que debera hacer dentro de las cuarenta y ocho horas siguientes a la notificacion de la presente providencia.
- CUARTO. LIBRESE comunicacion al mencionado Tribunal, con miras a que se surta la notificacion de esta providencia, segun lo establecido en el articulo 36 del Decreto 2591 de 1991.
