- PRIMERO. REVOCAR la sentencia de la Honorable Corte Suprema de Justicia, Sala de Casación Civil, de 28 de enero de 1993 y, en su lugar, confirmar la sentencia del H. Tribunal Superior del Distrito Judicial de Armenia, en el sentido de tutelar el derecho al debido proceso y DECLARAR SIN EFECTO la diligencia de secuestro del inmueble "El Retiro", ubicado en la vereda La Cabaña, jurisdicción del municipio de Armenia, Quindío, practicada el 15 de mayo de 1992, por el Juez
- Segundo. Civil Municipal de Armenia, por comisión del Juzgado
- Primero. Civil del Circuito de Armenia, dentro del Proceso de ejecución adelantado por HERNAN HERRERA GIRALDO contra HUMBERTO JARAMILLO BOTERO.
- SEGUNDO. Comunicar la presente decisión al Honorable Tribunal Superior del Distrito Judicial, Sala de Decisión Civil, para los efectos de la notificación de las partes, de conformidad con lo establecido en el artículo 36 del Decreto 2591.
- TERCERO. Compulsar copias dirigidas a la Fiscalía General de la Nación con el fin de que proceda a investigar la conducta del abogado ejecutante HERNAN HERRERA GIRALDO y de su poderdante HUMBERTO JARAMILLO BOTERO, para establecer si incurrieron o no, en el delito de fraude procesal.
- CUARTO. Compulsar copias a la Procuraduría General de la Nación, con el fin de que se ordene la investigación de la conducta del señor Juez

- QUINTO. Oficiar al señor Juez
- Primero. Civil del Circuito de Armenia, copia de esta sentencia y ordenarle que, en consecuencia, se abstenga de proceder al remate del bien.
