Ley 1098 de 2006 “por la cual se expide el Código de la Infancia y la Adolescencia” artículo 68 y la Ley 54 de 1990 “por la cual se definen las uniones maritales de hecho y régimen patrimonial entre compañeros permanentes”, el artículo 68 regula los requisitos para adoptar, el aparte acusado es “conjuntamente los compañeros permanentes”, y el artículo 1 regula lo que se entiende por unión marital de hecho los apartes acusados son “un hombre y una mujer” “al hombre y la mujer” “forman pare de la unión marital de hecho”, el demandante considera que el régimen de adopción debe entenderse como un derecho se garantiza a hombre y mujeres con independencia de sus inclinaciones sexuales.
La Corte decide inhibirse de emitir un pronunciamiento de fondo por ineptitud sustancial de la demanda.
