- Primero. INHIBIRSE para conocer de la disposición normativa contenida en el numeral 6º del artículo 140 del Código Civil, según la cual es posible invocar la nulidad del matrimonio cuando existió rapto, por ineptitud de la demanda.
- Segundo. Declarar EXEQUIBLE el numeral 6º del artículo 140 del Código Civil, siempre y cuando el término "robada violentamente" se entienda como sean raptados y, en el entendido de que, en virtud del principio de igualdad de sexos, la causal de nulidad del matrimonio y la convalidación de la misma, puede invocarse por cualquiera de los contrayentes.
