- Primero. REVOCAR el fallo proferido por el Juzgado Doce (12) Civil del Circuito de Barranquilla, y en su lugar CONFIRMAR el fallo proferido por el Juzgado
- Noveno. Civil Municipal de Barranquilla, que amparo los derechos a la salud y a la vida del menor Casir Miranda Herrera.
- Segundo. ORDENAR a la organizacion Clinica General del Norte, que en el termino de cuarenta y ocho horas siguientes a la notificacion de esta sentencia, adopte todas las medidas que sean necesarias para asegurar la realizacion de la cirugia de retiro de material de osteosintesis al menor Casir Miranda Herrera, si asi lo consideran los medicos tratantes.
- Tercero. DECLARAR que le asiste derecho a la organizacion Clinica General del Norte, a obtener el reembolso de lo gastado en cumplimiento de la orden emitida por esta Sala y en consecuencia, podra repetir contra el Fondo de Solidaridad Social en Salud (FOSYGA).
- Cuarto. Para dar cumplimiento a lo senalado en el numeral anterior, el Fondo de Solidaridad y Garantia del Ministerio de Salud dispone de un termino de seis (6) meses contados a partir de la presentacion y formalizacion de las cuentas respectivas.
- Quinto. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
