- Primero. REVOCAR las sentencias proferidas por la Sala Laboral del Tribunal Superior de Bogotá y la Sala Laboral de Casación de la Corte Suprema de Justicia en el proceso de la referencia. En su lugar, CONCEDER la tutela de los derechos al trabajo en condiciones dignas y a la unidad familiar del señor Héctor Jairo Peláez Ramos.
- Segundo. ORDENAR a la Fiscalía General de la Nación que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, adopte las medidas necesarias para que el señor Héctor Jairo Peláez Ramos sea trasladado nuevamente a la ciudad de Bogotá.
- Tercero. Por Secretaría General de la Corte, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
