- Primero. REVOCAR la sentencia proferida por la Sala Civil del Tribunal Superior de Bogota, el 24 de febrero de 2004 en la accion de tutela instaurada por David Humberto Ojeda Awad contra el Instituto de Seguros Sociales.
- Segundo. ORDENAR al Instituto de Seguros Sociales que en el termino improrrogable de quince (15) dias, profiera la resolucion correspondiente al reconocimiento de la pension de jubilacion del senor David Humberto Ojeda Awad, en la cual se de aplicacion efectiva al principio de favorabilidad a que se refiere el articulo 53 de la Constitucion Politica y, en consecuencia, se le reconozca la pension solicitada con fundamento en los requisitos que para el efecto se exigen en la Ley 33 de 1985.
- Tercero. PREVENIR al Instituto de Seguros Sociales para que en el futuro de aplicacion al principio de favorabilidad en la aplicacion e interpretacion de las fuentes formales del derecho, al momento de resolver sobre el reconocimiento y pago de prestaciones sociales.
- Librense por Secretaria, las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
