- Primero. REVOCAR la sentencia proferida por el Juzgado 11 Penal del Circuito de Bogotá, el 15 de enero de 2004, por las razones expuestas en esta providencia.
- Segundo. CONCEDER la protección constitucional del derecho de petición solicitado por el señor Sergio Aldana Murayari y en consecuencia, ORDENAR al representante legal de CAJANAL, que dentro del término de cuarenta y ocho (48) horas, siguientes a la notificación de este fallo, expida, si aún no lo ha hecho, el acto administrativo que resuelva de manera clara, precisa y de fondo la solicitud elevada por el actor.
- Cuarto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
