- Primero. REVOCAR las sentencias proferidas por el Juzgado
- Tercero. Civil del Circuito de Bogotá y la Sala Civil del Tribunal Superior del Distrito Judicial de Bogotá.
- Segundo. CONCEDER la tutela de los derechos fundamentales al mínimo vital y a la seguridad social. ORDENAR a la Caja Nacional de Previsión Social, que dentro de los ocho (8) días siguientes a la notificación del presente fallo de revisión, revoque la Resolución 08029 de 29 de abril de 2002 y proceda a dictar el acto administrativo mediante el cual RESUELVA de manera favorable sobre el derecho que le asiste al señor FERNANDO YEPES a gozar de la pensión de su fallecido hermano, se gestione su inclusión en nómina y se proceda al pago de las sumas a las que tiene derecho.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
