- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. REVOCAR la sentencia de tutela proferida por la Sala de Familia del Tribunal Superior del Distrito Judicial de Bogotá, mediante la cual se confirmó la decisión del Juzgado 20 de Familia de Bogotá de denegar la tutela de la referencia.
- Segundo. En su lugar CONCEDER el amparo del derecho fundamental al debido proceso de la accionante y, en consecuencia, ORDENAR a la entidad accionada que, dentro de las cuarenta y ocho horas (48 horas) siguientes a la notificación del fallo de revisión, rehaga el trámite administrativo y resuelva, de acuerdo con la certificación que expida la autoridad competente sobre el grado de invalidez de la accionante, lo pertinente respecto de la prestación económica que ésta reclama.
- Tercero. Como medida de protección a la accionante, dadas sus circunstancias, se ordenará que mientras se adopta la decisión que corresponda, se le continúen prestando los servicios médico asistenciales a cargo del sistema de Salud de las Fuerzas Militares
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1.991.
