- R E S U E L V E :
- Primero. REVOCAR, en todas sus partes, la Sentencia del día dieciocho (18) de febrero de 1993, proferida por la Sala Laboral del Tribunal Superior del Distrito Judicial de Valledupar.
- Segundo. TUTELAR el derecho constitucional fundamental de petición del señor Alfredo Sánchez Bayona, por las razones expuestas anteriormente.
- Tercero. PREVENIR tanto a la Gobernación del departamento del Cesar como a la Secretaría de Educación del mismo, para que se abstengan de incurrir nuevamente en dichas acciones y, advertirles, que si procedieren de modo contrario, serán sancionados de conformidad con el decreto 2591 de 1991.
- Cuarto. NOTIFICAR al Ministerio de Educación Nacional, advirtíendole que, en caso de que el señor Alonso Sánchez Sanabria o su representante, haga ejercicio de su derecho constitucional de petición para lograr el reconocimiento de la pensión por invalidez, deberá dársele, como indica el mandato constitucional, una pronta resolución a la solicitud impetrada teniendo en cuenta la situación de debilidad manifiesta por al que atraviesa el interesado.
- Quinto. LIBRAR las copias de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí previstos.
