- PRIMERO. REVOCAR la sentencia del veintiocho (28) de abril de dos mil tres (2003) del Tribunal Superior del Distrito Judicial de Bogotá, Sala Civil, y en su lugar TUTELAR los derechos de la peticionaria a la igualdad, la familia, el mínimo vital y a seguridad social, en tanto mecanismo transitorio para prevenir la ocurrencia de un perjuicio irremediable.
- SEGUNDO. ORDENAR al Director General de la Caja de Retiro de las Fuerzas Militares que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, adopte todas las medidas necesarias para reconocer y hacer efectivo el derecho de la señora Lucila Botero de Pérez a recibir la pensión que correspondía al mayor (r) Pérez Pérez, mientras la jurisdicción competente decide sobre la legalidad de los actos administrativos reseñados en esta providencia.
- TERCERO. Por Secretaria General, líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
