- Primero. REVOCAR las sentencias proferidas, respectivamente, por el Juzgado
- Tercero. Penal Municipal de Valledupar y por el Juzgado
- Cuarto. Penal del Circuito de Valledupar, y en su lugar, CONCEDER la tutela por los derechos fundamentales a la maternidad, a la protección del recién nacido y al mínimo vital de la señora CLAUDIA MENDOZA DAZA.
- Segundo. ORDENAR a Salud Total E.P.S., Seccional Valledupar que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, proceda a pagar a la actora el valor de la licencia de maternidad que le corresponde, de conformidad con las razones expuestas en este fallo.
- Tercero. DÉSE cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
