Primero. REVOCAR las sentencias de dieciséis (16) de enero de 1998 y veintitrés de febrero de 1998 proferidas por el la sección segunda del Tribunal Contencioso Administrativo del Valle del Cauca y la sección cuarta de la Sala de lo Contencioso Administrativo del Consejo de Estado, respectivamente.
Segundo. CONCEDER la tutela interpuesta por Carlos Humberto Padilla López. La subdirección general de prestaciones económicas de Cajanal, si no lo ha hecho ya, deberá responder dentro del término de cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, el recurso de apelación contra la resolución 018290 de octubre 6 de 1997 que negó la pensión de gracia al peticionario.
Tercero. Se hace un llamado de atención a la Caja Nacional de Previsión Social para que no vuelva a incurrir en retardos en la tramitación de los recursos interpuestos ante dicha Institución.
Cuarto. LÍBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí previstos.
