- Primero. REVOCAR el fallo proferido por la Sala Civil y de Familia del Tribunal Superior de Barranquilla, el 23 de febrero de 2000. En su lugar, CONFIRMAR PARCIALMENTE la decisión del 19 de noviembre de 1999, del Juzgado 9º Civil del Circuito de Barranquilla, en cuanto concedió la acción de tutela de la referencia.
- Segundo. MODIFICAR el numeral
- segundo. de la sentencia del 19 de noviembre de 1999 del Juzgado 9º Civil del Circuito de Barranquilla, en el sentido de ORDENAR al Seguro Social, que, si todavía no lo ha hecho, resuelva, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, los recursos de reposición y en subsidio el de apelación, interpuestos por el accionante desde el 14 de junio de 1999, contra la Resolución 000162 del 26 de abril de 1999.
- Tercero. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
