- en nombre del pueblo y por mandato de la Constitución Política,
- R E S U E L V E:
- Primero. REVOCASE el fallo proferido el veintiocho (28) de enero de mil novecientos noventa y tres (1993), por el Consejo de Estado, Sala Plena de lo Contencioso Administrativo, mediante el cual se dispuso confirmar la sentencia del Tribunal Administrativo de Cundinamarca del 3 de diciembre de 1992, en cuanto se denegó la tutela impetrada por ALFONSO MANUEL LOPEZ COTERA.
- Segundo. CONCEDESE la tutela que se solicita y, en consecuencia, ORDENASE a la Directora General y a la Subdirectora de Prestaciones Económicas de la Caja Nacional de Previsión Social que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, resuelvan sobre la petición formulada por ALFONSO MANUEL LOPEZ COTERA el día quince (15) de octubre de mil novecientos noventa y uno (1991).
- Tercero. CONFIRMASE la parte del fallo de segunda instancia en la cual se ordena que la Procuraduría General de la Nación investigue la posible responsabilidad disciplinaria de los funcionarios de Cajanal en los hechos que motivaron la acción de tutela.
- Cuarto. LIBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
