- Primero. REVOCAR el fallo del 29 de enero de 1997, proferido por la Sala Laboral de la Corte Suprema de Justicia, mediante el cual confirmó totalmente el de la Sala Laboral del Tribunal Superior de Cúcuta, que amparó el derecho a la seguridad social y negó la protección de los demás derechos invocados.
- Segundo. TUTELAR solamente el derecho fundamental de petición de las menores LUZ DARY y JOHANA ROA GARCIA. En consecuencia, ordénase a la Caja Nacional de Previsión que, dentro del término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, resuelva -afirmativa o negativamente-, si ya no lo hubiere hecho y si el recurrente no ha acudido ya a la jurisdicción Contencioso Administrativa, el recurso interpuesto por el actor en representación de aquéllas.
- Tercero. REMITASE copia del expediente y de esta providencia al Procurador General de la Nación para lo de su competencia.
- Cuarto. SURTASE el trámite previsto en el artículo 36 del Decreto 2591 de 1991.
