- Primero. REVOCAR el fallo proferido por la Subsección A de la Sección Segunda del Consejo de Estado, el 3 de septiembre de 1999, dentro de la acción de tutela de la referencia. Y, CONFIRMAR la sentencia del 9 de julio de 1999, proferida por la sección segunda del Tribunal Administrativo de Cundinamarca, que negó las pretensiones de la acción de tutela.
- Segundo. REMITIR copia del presente fallo y de las pruebas recaudadas por esta Sala en el presente asunto, a la Procuraduría General de la Nación, de conformidad con lo expuesto en el numeral 13 de la parte motiva de esta sentencia.
- Tercero. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
