- Primero. REVOCAR la sentencia de la sección segunda del Tribunal Contencioso Administrativo del Valle del Cauca, del 12 de noviembre de 1997, en cuanto negó la tutela por considerar que operaba el silencio administrativo negativo.
- Segundo. NO CONCEDER la acción de tutela de la referencia, por cuanto nos encontramos frente a un hecho superado.
- Tercero. HACER UN LLAMADO A PREVENCIÓN para que la Caja Nacional de Previsión resuelva, dentro de un término razonable, los recursos interpuestos contra los actos administrativos que allí se profieran.
- Cuarto. COMUNICAR la presente sentencia a la Caja Nacional de Previsión y al accionante de la tutela.
- Quinto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
