- R E S U E L V E :
- PRIMERO. REVOCAR la sentencia proferida por la Sala Laboral de la Corte Suprema de Justicia el 17 de noviembre de 1994, por las razones expuestas en la parte motiva de esta providencia, y en su lugar conceder la tutela del derecho de petición del señor JOSE ARTURO SOSSA.
- SEGUNDO. ORDENAR al Instituto de los Seguros Sociales para que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, resuelva el recurso de reposición y en subsidio el de apelación formulado contra la Resolución No. 0006905 de octubre 19 de 1993, emanada de esa entidad, si para la fecha de la misma aún no se ha producido dicha decisión.
- TERCERO. LIBRENSE por la Secretaría General de la Corte Constitucional las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
