- Primero. REVOCAR la sentencia proferida por el Consejo de Estado -Sala de lo Contencioso Administrativo-, el dia 10 de julio de 1998, que declaro improcedente la tutela de la referencia y en su lugar CONFIRMAR el fallo del Tribunal Contencioso Administrativo de Cundinamarca -Seccion Segunda- del 4 de junio de 1998 que tutelo el derecho de peticion del actor. En consecuencia se ordena al I.S.S., que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de la presente sentencia resuelva los recursos interpuestos.
- Segundo. LIBRENSE las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991.
