Primero. REVOCAR el fallo proferido por el Juzgado
Primero. Laboral del Circuito de Bucaramanga el día diecisiete (17) de febrero del año en curso, mediante el cual denegó la tutela impetrada por VICTOR HUGO ROJAS VARGAS.
Segundo. CONCEDER la tutela del derecho fundamental de petición. En consecuencia, se ordena a la Subdirección de Prestaciones Económicas de la Caja Nacional de Previsión Social que, si ya no lo hubiere hecho, proceda a resolver -afirmativa o negativamente-, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, la solicitud de reliquidación de la pensión del actor.
Tercero. Envíese copia de este fallo a la Procuraduría General de la Nación para lo de su cargo.
Cuarto. SURTASE el trámite previsto en el artículo 36 del Decreto 2591 de 1991.
