- Primero. REVOCAR la sentencia proferida el (13) trece de mayo de 1998 por el Juzgado Once Laboral del Circuito de Santa Fe de Bogotá.
- Segundo. CONCÉDESE la tutela impetrada por ZOILA ROSA ARCINIEGAS ESPEJERO.En consecuencia, ORDÉNASE a la Caja Nacional de Previsión CAJANAL -Subdirección de Prestaciones Económicas- que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, resuelva de fondo, concreta y completamente, sobre la solicitud elevada por la actora el 12 de agosto de 1997.
- Tercero. La Procuraduría General de la Nación investigará la conducta disciplinaria de los servidores públicos de CAJANAL que hubieren dado lugar a la violación del derecho que se protege. En consecuencia, remítasele copia de este fallo.
- Cuarto. DÉSE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
