- Primero. REVOCAR los fallos proferidos por los juzgados Quince Penal Municipal y Sesenta y Siete Penal del Circuito de Santa Fe de Bogotá, que negaron la tutela impetrada por SERAFIN MARTINEZ MARTINEZ contra CAJANAL y, en su lugar, conceder la protección constitucional al derecho de petición.
- Segundo. ORDENAR a la Caja Nacional de Previsión Social CAJANAL que en el término improrrogable de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo resuelva de fondo y en todos sus aspectos, positiva o negativamente, la solicitud formulada por SERAFIN MARTINEZ MARTINEZ.
- Tercero. REMITASE copia del expediente y de este fallo al Procurador General de la Nación para lo de su cargo.
- Cuarto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
