- Primero. REVÓCANSE las sentencias proferidas el nueve de diciembre de 1997y el 26 de enero de 1998 por el Juzgado Ochenta y Tres Penal Municipal y el Juzgado Cincuenta y Cuatro Penal del Circuito de Santafé de Bogotá, respectivamente.
- Segundo. CONCÉDESE la tutela impetrada por ELBA AGUEDITA JUNCA DE AGUILAR.
- En consecuencia, ORDÉNASE a la Caja Nacional de Previsión CAJANAL -Subdirección de Prestaciones Económicas- que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, resuelva de fondo, concreta y completamente, sobre la solicitud elevada, el 20 de agosto de 1997, por la actora.
- Tercero. La Procuraduría General de la Nación investigará la conducta disciplinaria de los servidores públicos de CAJANAL que hubieren dado lugar a la violación del derecho que se protege. Remítasele copia de este fallo.
- Cuarto. DÉSE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
