- Primero. MODIFÍCASE la sentencia del Juzgado Ochenta y Dos (82) Penal Municipal de Santafé de Bogotá, de fecha veintisiete (27) de junio del año en curso, por las razones aquí expuestas.
- Segundo. CONCÉDESE la tutela solicitada, pero por la vulneración del derecho de petición del actor. Por tanto, ORDÉNESE a la Caja de Previsión Social del Distrito, que en el término de cuarenta y ocho (48) horas, dé respuesta en cualquier sentido, a la solicitud de pensión de jubilación presentada por el señor Mario Alberto Barbosa.
- Si la entidad demandada considera que la resolución que dictó en cumplimiento de la decisión de tutela que ahora se modifica debe mantenerse, porque la decisión allí adoptada es la misma que se va a proferir en cumplimiento del presente fallo, así podrá expresarlo ratificando dicha resolución.
- Tercero. Por Secretaría General, REMÍTANSE el expediente de tutela y este fallo, al Juez Ochenta y dos (82) Penal Municipal de Santafé de Bogotá, para los efectos consagrados en el artículo 36 del decreto 2591 de 1991.
