Primero. REVOCAR la sentencia proferida por el Juzgado
Primero. Laboral del Circuito de Santa Marta el treinta (30) de agosto de 1996, dentro de la acción de tutela de la referencia.
Segundo. CONCEDER la tutela del derecho fundamental de petición. En consecuencia, se ordena a la Caja Nacional de Previsión Social - Seccional Magdalena - , resuelva la petición presentada por la señora Emilia Esther García de Payares, a quien deberá notificar la respectiva decisión dentro del término de 48 horas, contadas a partir de la notificación de esta providencia.
Tercero. LIBRENSE, por Secretaría, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
