Primero. CONFIRMAR las sentencias proferidas por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Laboral, el veintiseis (26) de marzo de mil novecientos noventa y tres (1993) y por el Juzgado
Noveno. Laboral del Circuito de Santafé de Bogotá el cinco (5) de marzo de mil novecientos noventa y tres (1993), en cuanto declararon improcedente la acción de tutela con respecto a las pretensiones del demandante a que se ha hecho referencia en la parte motiva de esta providencia.
Segundo. MODIFICAR las sentencias mencionadas y conceder la tutela por violación del Derecho fundamental de petición y en tal virtud se ordena a la CAJA NACIONAL DE PREVISION SOCIAL resolver la petición elevada por GUILLERMO
SEGUNDO. ROCHA LARROTA, dentro del término improrrogable de cuarenta y ocho (48) horas, contado a partir de la notificación de esta sentencia, si para la fecha de esta última no ha sido resuelta la solicitud.
Tercero. LIBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991 para los efectos allí contemplados.
