- Primero. REVOCAR la sentencia de trece (13) de febrero de 1998 proferida por la sección segunda del Tribunal Contencioso Administrativo del Valle del Cauca, la cual negó la protección solicitada .
- Segundo. CONCEDER la tutela interpuesta. En consecuencia, se ordena a la Secretaría de servicios administrativos de la Gobernación del Departamento del Valle del Cauca para que, si no lo ha hecho, responda de fondo en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, sobre la petición de cesantías parciales de MARÍA LILIANA CAICEDO MOSQUERA.
- Tercero. ADVERTIR a la autoridad demandada que en ningún caso puede supeditar el reconocimiento y liquidación de cesantías parciales a la disponibilidad presupuestal.
- Cuarto. DAR cumplimiento a lo previsto por el artículo 36 del Decreto 2591 de 1991.
