Primero. REVOCAR la sentencia de la Sala Laboral del Tribunal Superior de Cali.
Segundo. CONCEDER la tutela interpuesta. En consecuencia, se ordena a la Secretaria de Servicios Administrativos de la Gobernacion del Departamento del Valle del Cauca para que, si no lo ha hecho, responda de fondo en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, sobre la peticion de cesantias parciales de LUIS EDUARDO AGUDELO COLLAZOS.
Tercero. ADVERTIR a la autoridad demandada que en ningun caso puede supeditar el reconocimiento y liquidacion de cesantias parciales a la disponibilidad presupuestal.
Cuarto. PREVENIR a la Secretaria Administrativa de la Gobernacion del Valle del Cauca que evite volver a incurrir en las omisiones ilegitimas que originaron el presente proceso, so pena de las sanciones legalmente correspondientes.
Quinto. DAR cumplimiento a lo previsto por el articulo 36 del Decreto 2591 de 1991.
