- Primero. REVOCASE el fallo de instancia, que negó la protección constitucional.
- En su lugar, CONCÉDESE el amparo invocado. En consecuencia, ORDÉNASE a la Secretaría de servicios administrativos de la Gobernación del Departamento del Valle del Cauca, que, si ya no lo hubiere hecho, proceda, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, al pago de las cesantías parciales reclamadas por el actor y a él ya reconocidas, junto con la indexación correspondiente.
- Si por la imprevisión administrativa, no hubiere partida presupuestal disponible, las cuarenta y ocho (48) horas se conceden para que se inicien los trámites correspondientes, con miras a efectuar las adiciones presupuestales que permitan el pago.
- Segundo. DESE cumplimiento a lo previsto por el artículo 36 del Decreto 2591 de 1991.
