- Primero. REVOCAR la Sentencia proferida el 13 de septiembre de 1994 por el Juzgado
- Tercero. Penal del Circuito de Ipiales, al resolver sobre la acción de tutela instaurada por FRANCISCO IBARRA JIMENEZ.
- Segundo. CONCEDESE la tutela impetrada y, en consecuencia, ORDENASE al Gobernador de Nariño que, si todavía no lo ha hecho, proceda dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, a cancelar totalmente los salarios atrasados de FRANCISCO IBARRA JIMENEZ, siempre que haya partida presupuestal disponible. En caso contrario, dentro del mismo término, iniciará los trámites correspondientes e informará de ello, en forma inmediata, al juez de primera instancia.
- Tercero. El cumplimiento estricto del presente fallo será supervisado y exigido por el Juez
- Tercero. Penal del Circuito de Ipiales.
- Cuarto. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
