- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E :
- Primero. CONFIRMAR el numeral
- primero. del fallo proferido por el Juzgado
- Tercero. Civil Municipal de Bucaramanga el dia 10 de noviembre de 1995.
- Segundo. REVOCAR el numeral
- segundo. del mencionado fallo y en su lugar, conceder la accion de tutela por vulneracion del derecho constitucional fundamental de peticion y, en consecuencia, ordenar al Instituto de Prevision Social de Santander, que dentro del termino de cuarenta y ocho (48) horas, contados a partir de la notificacion de esta Sentencia, resuelva la peticion presentada desde el 15 de octubre de 1993 por la senora Tulia Pinto Pinto, si para la fecha de esta decision no lo ha hecho.
- Tercero. COMUNIQUESE el contenido de esta decision al Juez
- Tercero. Civil Municipal de Bucaramanga, el cual notificara la sentencia de esta Corte a las partes, de conformidad con el articulo 36 del Decreto 2591 de 1991.
