- Primero. REVOCAR la sentencia proferida por el Juzgado Treinta y Nueve Penal del Circuito de Santafe de Bogota, D.C., por las razones expuestas en esta sentencia.
- Segundo. CONCEDER la tutela del derecho de peticion del senor Alvaro Quilaguy Mongui, ordenando a la Caja de Prevision Social de Santafe de Bogota, que en el termino de cuarenta y ocho (48) horas, contado a partir de la notificacion, den respuesta a la solicitud de reconocimiento y pago de salarios y prestaciones sociales, causados y no percibidos, presentado por el actor, tal como se indico en la parte motiva de esta sentencia.
- Tercero. COMUNICAR, por intermedio de la Secretaria General de la Corte Constitucional, el contenido de la sentencia al Juzgado Treinta y Nueve Penal del Circuito de Santafe de Bogota D.C., para que sean notificadas las partes, de conformidad con lo dispuesto en el articulo 36 del decreto 2591 de 1991.
