- Primero. REVOCAR la sentencia proferida por la Corte Suprema de Justicia, Sala de Casación Laboral, el 22 de agosto de 1996, en segunda instancia, y la proferida por el Tribunal Superior del Distrito Judicial de Cúcuta, Sala Laboral, el 19 de julio de 1996, en primera instancia, dentro de la acción de tutela de la referencia.
- Segundo. CONCEDER la tutela impetrada. En consecuencia, se ordena al Gobernador del Departamento del Norte de Santander que, si todavía no lo ha hecho, proceda, dentro de las 48 horas siguientes a la notificación de esta sentencia, a cancelar a los docentes NANCY ELENA PEÑA, SARA EDITH VILLAMIZAR, FRANCISCO VERA RODRIGUEZ, MARIA ZORAIDA MOGOLLON DE OROZCO, MARIELA RICO CAMARGO, MARTHA LEMUS RODRIGUEZ, AMIRA ORTIZ MALDONADO, ROSALBA RODRIGUEZ VERA, ANA MERCEDES RIVERA, JAIME A. RODRIGUEZ CABALLERO, NELSON EDUARDO RIVERA ALARCON, GLORIA ANAYA SILVA, EDGAR ENRIQUE ALVARADO, MARIA OLIVA VILLAMIZAR ROMERO, MARLENI GONZALEZ PEÑA, LUCY PATRICIA VALERO MORA, LUISA ELVIRA PATIÑO PINILLA, FANNY MEREYA MOGOLLON ALVAREZ, CARMEN YOLANDA ALVAREZ, MERCEDES MERCHAN BASTO, ALIX YANETH CALDERON, NUBIA ASTRID GUTIERREZ SOLANO, MARLENY CIFUENTES MORENO, CARMEN ROSA VARGAS O., MARIA ALICIA GONZALEZ PEÑA, CARMEN ROCIO VARGAS VERA y PAULA MORENO SUAREZ los salarios atrasados, correspondientes al año de 1996, con su respectivo reajuste, siempre que haya partida presupuestal disponible. En caso contrario, dentro del mismo término, iniciará los trámites pertinentes, de todo lo cual informará, inmediatamente, al juez de primera instancia.
- Tercero. CONCEDER la tutela del derecho fundamental de petición. En consecuencia, SE ORDENA al Gobernador del Norte de Santander resolver las peticiones presentadas por los docentes mencionados en el numeral
- segundo. de este Fallo, dentro del término de cuarenta y ocho (48) horas, contadas a partir de la comunicación de esta providencia.
- Cuarto. LIBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
