Primero. CONFIRMAR la sentencia proferida el 23 de julio de 1998 por el Juzgado 10 Civil del Circuito de Cali, que revocó la expedida por el Juzgado Promiscuo Municipal de Dagua (Valle), el 12 de junio del mismo año, en el sentido de tutelar los derechos a la salud y a un ambiente sano de OTONIEL ARCE en contra de la empresa ACUEDUCTOS Y ALCANTARILLADOS DEL VALLE DEL CAUCA S.A. -ACUAVALLE E.S.P.-.
Segundo. ADICIONAR la sentencia dictada en segunda instancia dentro del proceso objeto de revisión, para tutelar el derecho constitucional fundamental de petición del señor OTONIEL ARCE. En consecuencia, se ordena a la empresa demandada que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, se pronuncie de fondo sobre la petición elevada por el demandante, el 7 de mayo de 1998.
Tercero. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
