Primero. REVOCASE la sentencia proferida el 30 de Mayo de 1997 por el Juzgado Ochenta y uno Penal Municipal de Santa Fe de Bogotá.
Segundo. CONCÉDESE la tutela impetrada por LAZARO CRUZ ESPITIA. En consecuencia, ORDENASE a la Caja Nacional de Previsión CAJANAL -Subdirección de Prestaciones Económicas- que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, resuelva de fondo, concreta y completamente, sobre la solicitud hace tiempo elevada por el actor.
Tercero. La Procuraduría General de la Nación investigará la conducta disciplinaria de los servidores públicos de CAJANAL que hubieren dado lugar a la violación del derecho que se protege. Remítasele copia de este fallo.
Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
