- Primero. REVOCAR la Sentencia del veintiuno (21) de octubre de 2002, proferida por el Tribunal Superior del Distrito Judicial de Cali - Sala Laboral -, por las consideraciones expuestas en esta providencia.
- Segundo. TUTELAR el derecho fundamental de peticion del accionante y, en consecuencia, ORDENAR al Ministerio de Trabajo y Seguridad Social - Grupo Interno de Trabajo para la Gestion del Pasivo Social de Puertos de Colombia -, o quien haga sus veces, que dentro del termino perentorio de cuarenta y ocho (48) horas a partir de la notificacion de esta providencia, proceda a resolver, si aun no lo ha hecho, el recurso de reposicion interpuesto por el actor el dia 20 de mayo de 2002, contra la Resolucion No. 000268 "por medio de la cual se resuelve una peticion de sustitucion pensional".
- Tercero. LIBRENSE las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
